On March 9th the crash of a Toyota Prius in New York appears to be a case of driver error, police said.

In this case the vehicles accelerator was depressed 100 percent at the time of the collision. "There is absolutely no indication of any brake application", said Captain Anthony Marraccini, acting chief of the Harrison Police Department.

"I belive that this is what this case in telling us", Marraccini said of the data collected in the investigation.

On March 9th Toyota announced that its investigators could not find evidence to support the drivers claim.

However the California Highway Patrol last Wednesday stood by its initial report that it appeared that a 61 yr old man whose Prius sped down a San Diego freeway on March 8 was stomping heavily on the brakes.
